Please read these Terms of Service ("Terms") carefully before using WholeChildAI. These Terms govern your access to and use of the WholeChildAI website and service operated by ClevTech Solutions ("we," "our," or "us").

By creating an account or using WholeChildAI, you agree to be bound by these Terms. If you do not agree to these Terms, do not use our service.

We may update these Terms from time to time. Continued use of the service after updates constitutes acceptance of the revised Terms. We will notify users of material changes by email.

2. Description of Service

WholeChildAI is an AI-powered platform that helps parents, teachers, and other adult educators create personalized learning plans for the children they support. Our service uses large language models (currently OpenAI's GPT-4) to generate educational content tailored to individual students.

We reserve the right to modify, suspend, or discontinue any aspect of the service at any time with reasonable notice.

3. User Accounts

Eligibility

You must be at least 18 years old to create an account. By registering, you represent that you are an adult (18 or older). WholeChildAI is designed for use by parents, teachers, tutors, and other adult educators.

Account Security

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activity that occurs under your account
• Notifying us immediately of any unauthorized access at support@wholechildai.org

You may not share your account with others or create accounts on behalf of third parties without authorization.

Children's Accounts

We do not permit children under 13 to create accounts. Student information is entered by adult account holders on behalf of the children they support — children do not use WholeChildAI directly.

4. Acceptable Use

You agree to use WholeChildAI only for lawful educational purposes. You may not:

• Use the service to generate content that is harmful, abusive, discriminatory, or illegal
• Attempt to reverse-engineer, copy, or resell any part of the service
• Misrepresent AI-generated content as independently verified professional advice
• Use the service to train competing AI models
• Attempt to circumvent subscription limits or access controls
• Upload or transmit malicious code or interfere with the service's operation
• Violate any applicable laws or regulations

We reserve the right to suspend or terminate accounts that violate these terms.

5. Subscription & Billing

Free Tier

WholeChildAI offers a free tier with limits on the number of students and learning plans per month. Free tier features may change over time.

Paid Subscriptions

Paid subscriptions provide higher limits or unlimited access. Subscriptions are billed monthly or annually as selected at checkout. All payments are processed securely by Stripe.

Cancellation

You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period. We do not provide prorated refunds for partial billing periods, except where required by law.

Price Changes

We may change subscription prices with at least 30 days' notice. Continued use of a paid subscription after a price change constitutes acceptance of the new price.

6. AI-Generated Content Disclaimer

AI-generated content:

• May contain errors, inaccuracies, or outdated information
• Is not a guarantee of specific educational outcomes
• Should be reviewed by qualified educators before implementation
• Does not constitute professional educational, therapeutic, or medical advice
• May not account for all individual needs, disabilities, or circumstances

You are responsible for evaluating the appropriateness of any AI-generated content for your specific situation and the children in your care.

7. Intellectual Property

Our Content

WholeChildAI, its logo, branding, and underlying software are owned by ClevTech Solutions and protected by intellectual property laws. You may not copy, modify, or distribute our software or branding without permission.

Your Content & Generated Plans

You retain ownership of the student information you enter. Learning plans generated by the service based on your inputs are provided for your personal educational use. You may use, print, and share generated learning plans for the non-commercial educational purposes for which they were created.

Feedback

If you provide feedback or suggestions about our service, you grant us a non-exclusive, royalty-free license to use that feedback to improve WholeChildAI.

8. Limitation of Liability

To the fullest extent permitted by applicable law:

• WholeChildAI and ClevTech Solutions are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service
• Our total liability for any claim related to the service is limited to the amount you paid us in the 12 months preceding the claim
• We provide the service "as is" and "as available" without warranties of any kind, express or implied

Some jurisdictions do not allow limitation of certain warranties or liabilities, so some of these limitations may not apply to you.

9. Indemnification

You agree to indemnify and hold harmless ClevTech Solutions, its officers, directors, and employees from any claims, damages, or expenses (including reasonable attorney's fees) arising from your use of the service, your violation of these Terms, or your violation of any rights of another.

10. Governing Law

These Terms are governed by the laws of the United States. Any disputes arising from these Terms or your use of WholeChildAI will be resolved through binding arbitration or in the courts of competent jurisdiction, as applicable under law.
